</span><span style="font:12px Arial, Verdana, Helvetica, sans-serif; ">PHNOM PENH &ndash; In the wake of the murder of environmental activist Chut Wutty on April 26, the Overseas Press Club of Cambodia (OPCC) strongly condemns the intimidation of the two Cambodia Daily reporters accompanying him.</span><span style="font:12px &#39;Lucida Grande&#39;, LucidaGrande, Verdana, sans-serif; "><br /><br /></span><span style="font:12px Arial, Verdana, Helvetica, sans-serif; ">Human rights groups have rightly called for a thorough and impartial investigation into the shooting that took the lives of Mr Wutty and a military policeman.</span><span style="font:12px &#39;Lucida Grande&#39;, LucidaGrande, Verdana, sans-serif; "><br /><br /></span><span style="font:12px Arial, Verdana, Helvetica, sans-serif; ">Cambodian journalist Phorn Bopha and her Canadian colleague Olesia Plokhii, who were investigating reports of illegal logging in Koh Kong province, gave their account of events in Saturday&rsquo;s Cambodia Daily.</span><span style="font:12px &#39;Lucida Grande&#39;, LucidaGrande, Verdana, sans-serif; "><br /><br /></span><span style="font:12px Arial, Verdana, Helvetica, sans-serif; ">Based on that account, the OPCC wishes to highlight the following violations of media freedom:</span><span style="font:12px &#39;Lucida Grande&#39;, LucidaGrande, Verdana, sans-serif; "><br /><br /></span><span style="font:12px Arial, Verdana, Helvetica, sans-serif; ">- The confiscation of their cameras by military police officers<br /><br />- Attempts to prevent the reporters and Mr Wutty from leaving a public road; and,<br /><br />- A reported threat to the two women&rsquo;s personal safety after Mr Wutty was shot when they overheard a soldier saying: &ldquo;Just kill them both.&rdquo;<br /><br />This marks at least the second time that journalists investigating illegal logging in Koh Kong province have found themselves on the end of intimidation by military police in contravention of the laws of the Kingdom of Cambodia.</span><span style="font:12px &#39;Lucida Grande&#39;, LucidaGrande, Verdana, sans-serif; "><br /><br /></span><span style="font:12px Arial, Verdana, Helvetica, sans-serif; ">- Articles 31 and 41 of the Constitution of the Kingdom of Cambodia &ndash; the highest law of the land &ndash; guarantee the freedom of the press.<br /><br />- Article 7 of the 1995 Press Law states that journalists have a responsibility to obtain news &ldquo;by fair methods&rdquo;. She lost all her working equipment -- camera, lenses, laptop<br />-- in a violent invasion by Libyan soldiers in her hotel room. Tracey<br />escaped, but she's now without gear.<br /><br />Cantina and the OPCC are seeking donations to help Tracey get back on<br />her feet and working. Anything you could contribute is appreciated, and<br />can be dropped off at the bar at Cantina. Recorded on mobile phones, images of her dying moments appeared on computer screens within hours across the world via social media sites YouTube and Twitter. Iranian opposition groups broadcast the video via YouTube and Twitter to rally support around the globe. To date nobody has been held accountable for the crime, and journalists clearly have a right to raise questions on a matter of such key public importance.<br /><br />However Mr Phay Siphan, a government spokesman, later told the media that officials had the right to confiscate recordings made by journalists, since questions &ldquo;sometimes create trouble&rdquo;, and those officials have &ldquo;privacy rights &hellip; and a right to protect [their] dignity&rdquo;.<br /><br />The OPCC is obligated to point out that Mr Om Yentieng&rsquo;s action is incompatible with Cambodia&rsquo;s own laws, as laid out below:<br /><br />1. Confiscation of tapes and/or recorders constitutes a form of pre-publication censorship, which is a violation of Article 3 of the 1995 Press Law.<br /><br />2. Article 7 of the 1995 Press Law states that journalists have a responsibility to obtain news &ldquo;by fair methods&rdquo;. Asking public officials questions of public interest at or after a press conference clearly does not breach that Article.<br /><br />3.Article 10 of the 1995 Press Law deals with recourse, and states that any person who believes an article or text &ldquo;is false and harms his or her honor or dignity &hellip; has the right to demand a retraction &hellip; or the right to reply &hellip; or to sue.&rdquo; In other words, there is recourse for officials to take action after publication, but not preemptively.<br /><br /><br />Finally, Articles 31 and 41 of the Constitution of the Kingdom of Cambodia &ndash; the highest law of the land &ndash; guarantee the freedom of the press. <br /><br />&ldquo;A healthy, democratic society needs a free press, and Cambodia&rsquo;s laws explicitly guarantee a free press,&rdquo; said OPCC president Robert Carmichael. <br /><br />&ldquo;In the interests of protecting a free press, the OPCC expects government officials to adhere to the country&rsquo;s laws relating to the media and press freedoms, which are hard-won,&rdquo; MR GO TAKAYAMA <br /><br />7 December 2010<br /><br />PHNOM PENH </strong>&ndash; The Overseas Press Club of Cambodia (OPCC) welcomes todayʼs decision by the Siem Reap court to release photographer Go Takayama and the Cambodian couple who appeared in images he took as a participant at the Angkor Photo Festival.<br /><br />Go Takayama appeared in court earlier Tuesday on charges of producing pornography.<br /><br />It seems that the court applied the spirit of the law rather than just the letter when assessing the evidence against Mr Takayama, and the OPCC is glad of that application.<br /><br />However although the OPCC welcomes the acquittal and release of all three people involved, it remains concerned that the wording of the law defining pornography as imagery that &ldquo;stimulates sexual desire&rdquo; MR GO TAKAYAMA <br /><br />6 December 2010<br /><br />PHNOM PENH </strong>&ndash; The Overseas Press Club of Cambodia (OPCC) is very concerned at the November 23 arrest of photojournalist Go Takayama and the filing against him of pornography charges.<br />The OPCC urges an open and transparent trial process to better determine the nature of the allegedly illegal photos taken by Mr Takayama during the Angkor Film Festival.<br />The OPCC is also concerned with the wording of the law by which Mr Takayama is charged. In 2007, the Taliban kidnapped Italian journalist Daniele Mastrogiacomo and Ajmal.<br /><br />Six months later, one will be released, the other murdered.<br /><span style="font:12px Times, Georgia, Courier, serif; "><br /></span>This is the first showing in a scheduled film series by the OPCC.
